Tony's Thor clone cuts through Cap's forces and kills Goliath. It is only through the intervention of the Invisible Woman that Cap and his badly beaten allies are able to teleport away. Some of the heroes on both sides of the Civil War begin to question if they have joined the proper faction. Invisible Woman and the Human Torch split the FF in half by deserting to Cap's resistance. The Thunderbolts are called in.

Spider-Man decides he is fighting on the wrong side of the Civil War and crosses Iron Man. The New Thunderbolts are sent to bring him in and he is beaten badly but is rescued by the Punisher. Cap decides to use the Punisher to invade the Baxter building and steal the plans for Number 42 in the Negative Zone where all of the captured heroes are being held. DD is captured and taken to the prison.

The superhero training for the fifty state initiative gets underway. The Punisher breaks into the Baxter Building and steals the plans for the Negative Zone prison Number 42. When a pair of villains show up to join Cap's side, the Punisher shoots them. Cap beats on the Punisher who refuses to fight back. Cap's heroes make it to Number 42 only to find that it is a trap. Hulkling, however, has been impersonating Hank Pym and the prisoners incarcerated in Number 42 have been freed to fight on Cap's side. The final battle of the Civil War is about to begin.

The final battle of the Civil War begins. Cloak teleports the combatants from the Negative Zone to New York and the fighting intensifies. Hercules kills the Thor Clone. When a group of firefighters and police try to restrain Cap, he realizes the destruction being caused and calls for an end to the battle. Cap surrenders and is taken into custody. The fifty state initiative is implemented. The Mighty Avengers are formed. The FF are reunited. Tony becomes the director of SHIELD. Life, indeed, goes on.
